Privacy Policy

General terms

At Edmund, we take the security of your data seriously. While no security is absolutely secure, we have created this Privacy Policy to help you understand the steps we take to keep your information secure, to inform you of the information we collect, to explain how we use that information, and how we protect that information. This Privacy Policy is also subject to Edmund’s Terms and Conditions. By accessing our services or our website, you agree to this Privacy Policy. If you do not agree with this Privacy Policy, please stop use immediately and contact your account manager or use the contact information at the bottom of this policy to contact us directly.

Changes to this Privacy Policy

Edmund may at any time change this Privacy Policy. Prior to any changes and prior to collecting any data that is not already enumerated in this Policy, Edmund will provide notice to our customers through the website and/or through the email of record you have provided.

The data we collect

In order to keep your account secure, provide customer service, and to ensure that we comply with legal regulatory requirements, we will collect information about your company and certain individuals associated with your company. During the process of onboarding a new client and when certain account information changes, we will request the following information.

From institutions, we will collect the following information:

  • Entity's legal name, including all suffixes and prefixes, especially those identifying the corporate form of the entity (i.e. LLC, LP, Inc., Corp, Ltd., etc.);
  • Employer identification number or similar government-issued identification number;
  • Institution's physical address at its principal place of business (this must be an actual, physical address and not a P.O. Box);
  • Proof of legal existence. This can include a government-issued business license, appropriate legal documents, or state-certified Articles of Incorporation, Organization, or Limited Partnership;
  • A description of the institution’s business, including products and services, main customer types, and geographies served; and
  • List of beneficial owners (anyone owning 10% or more of the business).

From all Account Owners, Transaction Approvers, Transaction Initiators, beneficial owners, and key executive officers, we will collect the following information:

  • Full legal name, including all suffixes and prefixes;
  • Date of birth;
  • A physical address that is either a business or residential address but not a P.O. Box;
  • An identification that provides proof of identity and can include:
    • Social Security Number;
    • Taxpayer identification number;
    • Passport number and country of issuance;
    • Alien identification card number;
    • Or any other government-issued document that evidences nationality or residence and has a photograph of the individual.
  • Email address;
  • Phone number; and
  • Any other additional information that Edmund may require.

In addition to the personally identifiable information you provide to us above, Edmund will automatically collect other information each time that you log into your account that allows us to keep your account secure and provide you the best customer experience possible:

  • IP Address: We will collect the IP addresses used to access your account. This will allow us to confirm that your account is being accessed from an expected location.
  • Location: When you access your account through our interface, we will track the location that is used to access your account and we can use that information to confirm a transaction.
  • Operating system: In order to provide customer service and to address any account issues you may have, we will track what operating system you use to access your account.
  • Account Activity logs: In order to provide account security and to monitor for improper account activity, we will retain records of each time someone accesses your account and what actions are taken when the account is accessed.
  • Audio, video, and written communication: Each time you communicate with an Edmund employee, whether through audio, video, or in writing, we may record and retain the communication.
  • Information from third-party sources: In fulfilling our regulatory obligations we use third-party sources for identity verification and background checks.

How we use it:

  • To communicate with you, including responding to requests for information, service requests, or marketing.
  • To meet our legal and regulatory obligations and to provide information to law enforcement and regulators when necessary.
  • To prevent and investigate potential criminal activity and violations of our terms of service.
  • To provide a secure account and prevent any attempts to unlawfully access your account.
  • To collect fees.
  • To resolve disputes, protect the rights of Edmund or its customers, and to enforce Master Custody Agreements between Edmund and its customers.
  • To provide you Edmund’s services, including account statements and receipts for all transactions.
  • To improve system operations and customer experience, including fixing any system failures.
  • To provide information about your Edmund account, including new services, upcoming trainings, educational opportunities, and Edmund events.
  • To conduct targeted marketing.
  • To improve customer service through employee training.
  • To perform analytics in order to improve the functionality of our website.

Sharing information with third parties

Edmund will never sell, loan, or rent your data to any third party. Edmund will only disclose information to third-parties in the following circumstances:

  • To verify your identity with a third-party identity verification tool.
  • To conduct investigations and prevent fraud and other criminal activities or violations of our Terms and Conditions.
  • To resolve disputes, protect the rights of Edmund or its customers, and to enforce Master Custody Agreements between Edmund and its customers.
  • To our affiliates for systems upgrades and improvements.
  • To third party vendors that help to maintain our services.
  • To perform analytics in order to improve the functionality of our website.
  • With your consent.

How we protect and store

While no storage system is completely secure, Edmund takes the security of your data seriously. We use several methods to secure your information, including encryption, physical separation, and other electronic means.

Edmund employees will only have access to your information on a need-to-know basis in order to provide you with services or to communicate with you.

How to access or change your personal information

You are entitled to ensure that the information that we maintain is accurate. You can request access to your personal information and correct the information if necessary. You are also entitled to request the categories of information that we hold, subject to the limitations of regulations, including our know-your-customer and anti-money laundering obligations.

Retention of personal information

We strive to ensure that information that we maintain is not retained longer than is necessary for its purpose. The length of time that we keep information is dependent on a number of factors, including the type of information and regulatory requirements. We will retain all of your information for the life of your contract with Edmund, in accordance with our document retention policies and procedures, and with applicable laws and regulations. This retention period may change as laws and regulations change.

Direct marketing

We may use the information we collect to market our own products and services to you. By providing us with your email address, you agree to receive this direct marketing. You may opt-out of this direct marketing at any time by contacting us at privacy@edmundhq.com. We do not sell your data for any marketing purposes and will only share information with third-party marketing vendors with your express written consent.

Children

Edmund does not intentionally collect any information on customers younger than 18 years old. If Edmund learns that it has collected information or opened an account on anyone younger than 18 years old, Edmund will require the customer to close the account immediately and will delete any information related to that individual, subject to regulation. If you are aware of a customer younger than 18 years old using our services, please contact us immediately.

Do Not Track disclosure

We do not respond or recognize browser-based Do Not Track signals.

For California residents

California residents may have protection afforded to them pursuant to the California Consumer Privacy Act of 2018 (the “Act”). Under this Act, you may request additional information about the information we collect, how we use that information, how we share that information with third-parties, and your rights under the Act. Subject to exceptions and limitations found in the Act, California residents may have the right to the following:

  • Right to request access: You may request your specific personal information that we have collected, used, and shared over the prior 12 months.
  • Right to opt-out of the sale of your information: The Act allows you to opt-out of any sale of your personal information. Remember, Edmund will never sell, rent, or loan your personal information.
  • Right to be deleted: Subject to the exceptions in the Act, you may submit a request to delete the information we have collected. This is not an absolute right and we may decline the request.
  • Right to receive non-discriminatory treatment: Edmund will never discriminate against any customer based on any privacy elections.

If you would like to request access to your information or would like to request your email address to be deleted, you may send your request to privacy@edmundhq.com.

You may designate an authorized agent to make requests on your behalf. The authorized agent must submit proof that they have been authorized by you and we will reject any request if sufficient proof is not supplied.

Customers located in an EU General Data Protection country

When using Edmund’s services, your information will be sent to the United States. You acknowledge and consent that we may send your information to the United States. This consent may be withdrawn at any time, however, withdrawal of consent will likely result in the termination of your access to Edmund’s services. To the extent applicable and subject to certain exceptions and limitations in the law, we adhere to the relevant provisions of the EU General Data Protection requirements. This includes:

  • Right to access and correct: Upon request, you may access the information that we have collected and correct any incorrect or incomplete data.
  • Right to be forgotten: Under certain circumstances and subject to the limitations of the law, you may request that we erase your personal data.
  • Right to data portability: You have the right to receive your personal data that you have provided to us, in a structured, commonly used and machine-readable format and have the right to transmit that data.
  • Rights to restriction of processing: You make request or object to our processing of your information under certain circumstances.

In order to process your information, we rely on one or more of the following legal bases for processing:

  • Consent: You have consented to the processing of your information. You may withdraw your consent at any time, but we may rely on multiple legal basis for using your information.
  • Contractual Obligation: To provide you the services that we have contractually agreed to.
  • Legal Obligation: To meet our regulatory requirements of anti-money laundering and document retention.
  • Legitimate purpose: To maintain the security of our user interface and other systems.

Automated individual decision-making

Edmund does not use entirely automated decision-making.
